Point of Pride’s Statement on Florida Court's Ruling Reinstating Law Restricting Gender-Affirming Care

On August 26, 2024, the 11th Circuit Court of Appeals in Florida reactivated a 2023 law that severely restricts access to gender-affirming care for transgender individuals of all ages. This decision follows a brief period of relief when the law was permanently blocked in June 2024, giving hope to countless families and individuals seeking vital medical treatment.
The reinstated law imposes harsh restrictions on medical professionals and trans patients, exacerbating the stigmatization and marginalization of those seeking essential care. It stands in stark opposition to the overwhelming consensus of medical experts, including the American Medical Association and the American Academy of Pediatrics, who recognize gender-affirming care as safe, effective, and medically necessary.
"Point of Pride had put safeguards and workarounds in place when this legislation was initially signed into law in 2023," said Tyler Rodriguez, Director of Programs at Point of Pride. "Now, we're once again faced with the challenge of helping these individuals access life-saving care, often requiring them to travel hundreds of miles. This not only places a significant burden on them but also strains our organization’s resources as we redirect funds to assist with transportation, missed work, and other logistical challenges they face in a state that continuously questions their rights and existence."
Point of Pride has already contacted providers serving those in Florida to ensure the safety and continued care of our recipients. However, the implications of this ruling extend beyond just travel difficulties. "Providers across the board are increasingly wary of treating trans patients," Rodriguez added. "We've seen surgeries canceled or rescheduled, faced challenges in establishing relationships with hair removal providers, and dealt with increased administrative burdens. This ruling intensifies those challenges for our recipients and their care providers alike."
Aydian Dowling, Chief Advancement Officer and co-founder of Point of Pride, expressed the organization's deep concern: "We are deeply disheartened and outraged by this decision. This ruling directly undermines the rights and well-being of trans and gender-diverse people, putting lives at risk by stripping away access to necessary and life-saving healthcare. Gender-affirming care is not just medical treatment: it is a critical component of the mental, emotional, and physical health of trans individuals."
